Производство открыто из-за недавних президентских выборов в России: глава МВД, считают в Москве, мешал россиянам голосовать на территории Украины
Следственный комитет России открыл уголовное производство против министра внутренних дел Арсена Авакова: в Москве считают, что тот «препятствовал свободному осуществлению россиянами избирательных прав на выборах президента России» в Украине.
Соответствующая запись появилась сегодня, 3 апреля, на сайте Следкома РФ, передает LIGA.net.
Дело заведено по ч. 2 ст. 141 УК РФ, санкции которой предусматривают наказание вплоть до 5 лет тюрьмы.
Следователи силовых органов государства-оккупанта убеждены, что 18 марта Аваков, «действуя группой лиц по предварительному сговору, давал указания подчиненным по службе сотрудникам МВД, обеспечивающим охрану и безопасность российских дипучреждений в Киеве, Львове, Одессе и Харькове, не пропускать на избирательные участки граждан РФ на территории Украины для участия в выборах президента РФ».
Исходя из этого и ссылаясь на ст. 12 УК РФ, российский Следком аргументирует уголовное преследование Авакова тем, что «иностранные граждане и лица без гражданства, не проживающие постоянно в РФ, совершившие преступление вне пределов РФ, подлежат уголовной ответственности по российскому уголовному законодательству/
В случаях, если преступление направлено против интересов РФ либо гражданина РФ, а также в случаях, предусмотренных международным договором РФ или иным документом международного характера, содержащим обязательства, признаваемые РФ, если иностранные граждане и лица без гражданства, не проживающие постоянно в РФ, не были осуждены в иностранном государстве и привлекаются к уголовной ответственности на территории РФ».
На выборах российского президента, которые состоялись 18 марта 2018 года, действующий хозяин Кремля Владимир Путин набрал больше 76,67 % голосов избирателей.
